Terms of Use for Report A Scam

Effective Date: 10 October 2025

Last Updated: 21 August 2026

Acceptance and Scope

These Terms of Use govern your submission of fraud reports through Strategy India’s “Report A Scam” system. By accessing the System or submitting a report, you unconditionally agree to be bound by these Terms and the Privacy Policy. Strategy India acts solely as a private intelligence-gathering, analysis and advisory consultancy; we are not a law enforcement agency, consumer court, financial recovery service, or regulatory body.

Eligibility and Good Faith

You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into binding agreements under the Indian Contract Act, 1872. You warrant that the information in your report is true to the best of your knowledge, submitted in good faith for consumer protection, and that all evidence was obtained lawfully without violating non-disclosure obligations or privacy rights.

Accuracy and False Reporting

You are obligated to provide truthful information. Knowingly false, fabricated, or maliciously misleading reports are strictly prohibited. Submitting false accusations may expose you to civil liability for defamation and malicious prosecution, as well as criminal penalties under the Bharatiya Nyaya Sanhita, 2023, and the Whistleblower Protection Act, 2014.

Use of Information and Publication

You authorise Strategy India to analyse your report, share relevant details with law enforcement, and publish anonymised scam alerts and case studies. Once information is shared with authorities or published as an anonymised alert, Strategy India cannot control how third parties, the media, or the courts utilise or republish the information.

No Guarantee of Outcomes

Strategy India explicitly disclaims any guarantee that investigation agencies and law enforcement will investigate your report, that offenders will be prosecuted, or that fraudulent operations will cease. We do not provide financial recovery assistance, compensation, or legal representation.

Prohibited Conduct

You agree not to abuse the System by submitting spam or trivial reports, or by using the platform for competitive sabotage or personal vendettas. You shall not provide evidence obtained through illegal means, such as hacking or unlawful wiretapping, nor shall you submit obscene or unlawful content. Impersonating others or attempting to compromise Strategy India’s network security is strictly prohibited.

Intellectual Property and Licence

By submitting a report, you grant Strategy India a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, modify, and publish the report and evidence for fraud analysis, law enforcement coordination, and public awareness. All content generated by Strategy India remains our exclusive intellectual property.

Indemnification and Malicious Prosecution Safeguards

You agree to indemnify, defend, and hold harmless Strategy India, its partners, and employees from any claims, damages, or legal fees arising from your fraud report, your breach of these Terms, or third-party claims alleging defamation, commercial disparagement, or malicious prosecution. Strategy India’s good-faith transmission of your report to authorities after analysis is protected by qualified privilege, and we shall not be held vicariously liable for your acts or omissions.

Limitation of Liability

To the maximum extent permitted by Indian law, the System is provided “AS IS”. Strategy India disclaims all warranties and shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the System, law enforcement actions, retaliation by alleged fraudsters, or data breaches. Should liability be established, our total aggregate liability shall not exceed INR 50,000.

Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, administered by the Mumbai Centre for International Arbitration (MCIA), with the seat in Mumbai, Maharashtra, India.
